5 Step Process

STEP 1 | LIEN RELEASE REQUEST

This package contains 4 documents

1. An official DMV lien release form

2. A letter of non-interest

3. A declaration affidavit

4. A standard title application.

DO NOT contact the lienholder by phone, email, or other messaging, only use postal mail.

In many cases, the clerk at the office will look up your VIN and see that it is a charge off or write off, and validate the lien release. At that point the vehicle would be free and clear.

STEP 2 | COURT ORDERED TITLE

Submit the petition for court order along with:

• The Declaration of Interest

• Affidavit of Facts.

If the court recognizes that the lienholder has no viable interest in the vehicle due to waiving their rights or non-response, the court can issue a judgment of ownership clearing the title.

STEP 3 | LIEN MITIGATION

This is a h i d d e n program offered by lienholders to equalize the loan amount with reasonable financial terms.

This can allow for lower payments or outright waiver of principle.

STEP 4 | SHORT SALE OFFER

Submit for a short sale

In this scenario, you connect with a buyer for the vehicle at m a r k e t v a l u e (dealer, auction, private sale), and arrange for the lienholder to accept that amount in advance to wipe out the entire loan balance and pass the title to the buyer.

STEP 5 | GOVERNMENT PROGRAMS

apply for a goverment program

There are government programs for distressed borrowers and lenders with delinquent instruments to minimize the losses.

These can be applied for using the appropriate forms for those programs.
